Non-Discrimination Policy

Purpose

At All Things Diverse LLC, we aim to foster an inclusive, equitable, and respectful workplace where everyone can thrive. This policy underscores our commitment to providing a work and learning environment free from discrimination, and it ensures all participants understand their rights and responsibilities in upholding these values.

Policy Statement

Discrimination based on race, color, religion, sex (including pregnancy, sexual orientation, or gender identity), national origin, disability, age (40 or older), or genetic information (including family medical history) is illegal and will not be tolerated.

Employees, learners, instructors, staff, contractors, and stakeholders are encouraged to report any discrimination against themselves or others. If you believe discriminatory behavior has taken place, report your concerns directly to the Organization Development Partner (Human Resources).

Standard Definitions

Discrimination. Any act or omission that treats an individual unfairly or unequally based on a protected characteristic.

Harassment. Unwelcome conduct based on a protected characteristic where enduring the conduct becomes a condition of continued participation or employment, or where the conduct is severe or pervasive enough to create an intimidating, hostile, or offensive environment.

Retaliation. Any adverse action taken against an employee, learner, instructor, staff member, contractor, or stakeholder because they reported discrimination, participated in an investigation, or otherwise opposed discriminatory conduct. Retaliation is prohibited and is treated as a separate violation of this policy.

Confidentiality. Protecting the identity and information of individuals who report discrimination or participate in investigations, to the greatest extent possible under the law.

Reporting and Investigation

Employees, learners, instructors, staff, contractors, and stakeholders may report discrimination verbally or in writing to the Organization Development Partner (Human Resources).

How to report

Reports may be submitted by email to [email protected], by phone at (619) 669-8689, or by mail to All Things Diverse LLC, 11250 Old St Augustine Rd, Ste 15 #218, Jacksonville, FL 32257. Reports may also be submitted through our online reporting form at Report A Concern

You may report a concern in person to the Organization Development Partner at any time. A report made verbally carries the same weight as a report made in writing, and we will document it on your behalf.

What happens next

  1. Acknowledgment. We acknowledge receipt of the report within 5 business days.
  2. Investigation. All complaints are investigated promptly and thoroughly. The investigation is conducted by the Organization Development Partner or a designated impartial party and is completed within 30 business days of acknowledgment. If a complaint requires additional time, we notify the reporting party in writing before day 30 with the reason for the extension and a revised completion date.
  3. Resolution. We communicate the outcome to the reporting party in writing within 10 business days of completing the investigation.
  4. Corrective action. Substantiated violations result in corrective action up to and including removal from a program, termination of a contract, or termination of employment.

The confidentiality of anyone who reports discrimination or participates in an investigation will be protected to the greatest extent possible under the law.

Appeals

A participant who disagrees with the outcome of an investigation may submit a written appeal to the Chief Executive Officer within 10 business days of receiving the outcome. The appeal must state the basis for disagreement and include any supporting information. The CEO issues a written decision within 20 business days of receiving the appeal. Appeal decisions are final.

Recordkeeping

Records of complaints, investigations, outcomes, and appeals are retained for 7 years in a secure, access-restricted file. This retention period matches the minimum record retention requirement for learner records under the IACET Standard. Records related to a charge filed with the Equal Employment Opportunity Commission or a comparable state agency are retained until the matter and any resulting litigation is fully resolved, even if longer than 7 years.

Policy Review

This policy is reviewed annually and updated as needed to remain current with applicable law and the ANSI/IACET 1-2018 Standard for Continuing Education and Training.
